Terms of service

Last updated Oct 23, 2026.

1. Provider and scope

Facade Repair Radar is provided by Christoph Ploner, Georg Hahnekampstraße 13, 7000 Eisenstadt, Austria (see Imprint), referred to as "we" or "us". The service is offered exclusively to businesses; consumers may not subscribe. These terms apply to every plan, to the basic plan and to free test access granted before October 23, 2026. Terms of the customer apply only if we agree to them in writing (e-mail is sufficient).

2. The service and what we promise

We provide a list, samples and an online subscriber area derived from public datasets of the City of New York (Department of Buildings facade filings, job filings, permits and violations, HPD registration data, PLUTO and other public City datasets). The list contains buildings with a filed cycle 10 report under the Facade Inspection & Safety Program rated SWARMP or UNSAFE, together with the inspection firm that filed the report, sidewalk shed information, estimates of penalty exposure and job size, the managing agent and the owner entity. In the subscriber area the customer's team can track its work on these cases.

Our promise: Facade Repair Radar lists buildings with a filed cycle 10 SWARMP or UNSAFE report that show no visible repair activity in public NYC Department of Buildings data. We re-check every listed building weekly. Work done without a permit, and contracts that have not been filed with the Department, cannot be seen; a listed building may therefore already have a contractor. We do not guarantee that any case is still open, that any owner will hire a contractor, or that you will be invited to bid.

The service is an information service. It is not legal, engineering or compliance advice. We do not broker contracts, receive commissions or success fees, or place firms on bidder lists, and we do not introduce or recommend you to any owner, managing agent or engineer. Penalty amounts and job sizes shown are estimates derived from public rules and filings, not fines that are due, quotes or bids. Facade Repair Radar is an independent service and is not affiliated with, endorsed by or connected to the New York City Department of Buildings or any other agency of the City of New York.

3. Accuracy, "Already taken" and changes in the rules

The data is derived from government datasets as published, which may be incomplete, late or incorrect. We describe our method and the data date on every list (see Method). Verify every filing in DOB NOW before you act.

Every case has an "Already taken" button. If you report a case as taken, we hide it for your firm and re-check it; if several subscribers report the same case without public evidence, we may mark it for all subscribers or remove it. Reports are not a complaint procedure and do not entitle you to a refund for individual cases.

The service follows the rules of the Facade Inspection & Safety Program and of Local Laws 48 and 51 of 2025 as they currently stand. The City may change these rules or their enforcement. Such changes can change which buildings are listed and the estimates shown; we adapt the service to the rules in force. Section 6 applies if a change materially reduces the core of the service.

4. Licence and permitted use

A plan gives one firm a non-exclusive, non-transferable right, for its term, to use the list, samples and subscriber area for its own internal business development. It includes personal access for team members of that firm up to the number stated on the website (currently 10). Access for further people or other firms requires our agreement.

You may not resell, publish, license or otherwise pass on the list, in whole or in substantial part, to anyone outside your firm; you may not share access links with people outside your firm, extract the data systematically by automated means or use the service to build a competing product or database.

Fair use towards owners and engineers. You may not use the list for mass unsolicited mailings, calls or visits to building owners or residents. The inspection firm that filed the report usually prepares the repair scope and runs the bid on the owner's behalf; please respect that role and approach owners, managing agents and engineers in a professional, individual way. You are responsible for complying with applicable law and professional rules when you contact anyone, including the CAN-SPAM Act, the Telephone Consumer Protection Act and New York consumer protection law. Our price is a flat fee for data and software; it is not contingent on and not related to any contract you may win.

An inspection firm may ask us through our contact form to hide its name in the contractor list; we then show "inspection firm on file" instead. The underlying data published by the City of New York is public; nothing in these terms restricts your use of that public data obtained from the original source. Our rights relate to our own work: the selection, classification and arrangement of the data, the re-checks, estimates and labels and the subscriber area.

5. Purchase, payment, term and renewal

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all orders placed through Paddle and handles customer service inquiries and returns relating to payment. If an order is instead processed through another payment service, the checkout page names that service; where it acts as merchant of record, it is the seller for the payment, otherwise we are the seller and the service only processes the payment on our behalf. In every case the service itself is provided by us under these terms. Prices are shown on the website; the merchant of record may add applicable taxes.

The plans (NYC annual, Outer Boroughs annual) run for 12 months from the start date and renew for a further 12 months unless automatic renewal is switched off before the renewal date. We e-mail you at least 15 and at most 30 days before each renewal (General Obligations Law § 5-903); any change of the regular price applies only from a renewal and is stated in that e-mail. You can switch off automatic renewal at any time before the renewal date; it then takes effect at the end of the current term, and your access continues until then. The founding price shown on the website applies to the first 10 paid plans of Facade Repair Radar (all packages together) or to plans paid by March 31, 2027, whichever comes first; reservations without payment do not count. A firm that pays the founding price keeps it at every renewal for as long as the plan continues without interruption; this also applies to a switch under section 5b. If a plan ends and you subscribe again later, the price then shown on the website applies. After the 10th paid plan, or from April 1, 2027, new plans are charged at the regular price. If orders for the last founding place are paid at the same time, each of them keeps the price it was charged. A refunded or reversed payment does not count; its place becomes available again. We show the number of remaining founding places once five plans have been paid. Dates in this section refer to New York time.

5a. Refunds

Fees are non-refundable except where required by law or where these terms provide for a pro-rata refund (sections 6, 7 and 8).

5b. Switching between plans

You may switch from Outer Boroughs annual to NYC annual at any time. If you switch within the first 90 days of the current term, the full amount you paid for the current Outer Boroughs term is credited against the NYC price that applies to you (founding or regular price). If you switch later, the credit is that amount pro rata for the full months remaining in the current 12-month term. You pay the difference. The NYC plan then runs 12 months from the switch; the Outer Boroughs plan ends on that day without a further refund. We arrange the switch on request through our contact form and send a payment link for the difference. Your access link, team, statuses and notes are kept.

5c. Free test access granted before October 23, 2026; feedback

We no longer grant free test access. A firm that received free test access before October 23, 2026 keeps it until the end date stated in its welcome e-mail or subscriber area; the end date is not extended. Free test access is free of charge, is not a subscription, does not renew and ends automatically without notice of termination. Either party may end it early: you through our contact form, we by e-mail. For a later purchase the same prices apply as for every other firm.

Any subscriber may give a short written feedback in the subscriber area; no calls or meetings are required. We publish a quotation only if you expressly choose that option, only in your own words (we may shorten it, marked with an ellipsis, but never reword it) and only in the form you chose (with your name and firm, or anonymously with role, type of firm and borough). Every quotation from a firm that received free test access is published with the note "Received free test access in exchange for feedback"; this note cannot be removed. You can withdraw the permission at any time through our contact form; we then remove the quotation without undue delay.

5d. Free basic plan

When a plan or earlier free test access ends (expiry, end of the test access or switched-off renewal), the account owner keeps a free basic plan under the same access link: the five open cases with the highest priority in the borough the owner chooses, updated with each data run, and the owner's work list. The basic plan does not include the first contact (inspection firm), managing agent, owner entity, direct links, CSV export, templates or team access; team members' access ends. We send a short e-mail with these cases about every four weeks; each e-mail has a one-click link to stop them. The basic plan is free of charge and does not create a subscription. It does not apply after a refund or a termination for good cause (section 7). It ends if the account owner has not opened it for 12 months; your work data is then deleted as described in section 8. We may change or discontinue the basic plan with 30 days' notice by e-mail. Buying a plan restores full access under the same link.

5e. Referral bonus

Each account has a personal referral link in the subscriber area. If another firm opens Facade Repair Radar through that link and then buys a plan and pays for it, the referring account receives two extra months: for a plan, the next renewal date moves two months later (nothing is charged before the new date). The bonus is limited to 12 months per account in total and is granted once per referred firm, for its first payment. A referral does not count if the buying firm is the referring firm itself or belongs to it (for example the same e-mail domain), if either side uses a free e-mail address, or if the referring account has no running plan when the payment arrives. A refunded purchase does not create a bonus. The bonus has no cash value, is not a commission and cannot be transferred. We do not tell the referred firm anything about your account and do not tell you which firm subscribed.

6. Availability and changes to the service

We aim to keep the website and subscriber area available at all times but do not guarantee any particular availability or response time. Data updates depend on the City of New York publishing its data; if it publishes late, changes or withdraws a dataset or stops publishing, our updates are delayed or changed accordingly.

We continue to develop the service and may change features, layout, data fields and methods. If a change, including one caused by the data sources or by changes in the rules (section 3), materially reduces the core of the service you paid for, we tell you by e-mail at least 30 days in advance, or as soon as we learn of it if the cause is outside our control. You may then terminate with effect from the change and receive a pro-rata refund of fees prepaid for the remaining term.

7. Termination

You end a plan by switching off automatic renewal (section 5). Earlier free test access ends automatically (section 5c). After any of these ends, the free basic plan applies (section 5d). We may discontinue the service as a whole, or for a package, with at least 90 days' notice by e-mail; fees prepaid for the period after the end of the service are refunded pro rata.

Either party may terminate for good cause with immediate effect. Good cause on our side includes in particular resale or redistribution of the list, sharing access with people outside your firm, systematic automated extraction of the data, mass unsolicited contact of owners or residents, or using the service for unlawful contact. Except in serious cases we first ask you by e-mail to stop the breach. If we terminate for good cause caused by you, prepaid fees are not refunded.

When the plan ends, full access for you and your team members ends; the account owner keeps the free basic plan (section 5d), except after a refund or a termination for good cause. Before that date you can export your work list from the subscriber area.

8. Your work data (data processing)

What you and your team enter in the subscriber area (statuses, notes, follow-up dates, assignments, "Already taken" reports, the activity history, saved views and the names and business e-mail addresses of team members) is your data. Where it contains personal data, we process it as your processor under Art. 28 GDPR, and these terms form the data processing agreement. The subject matter is the hosting and operation of the subscriber area for the term of your plan; the data subjects are your team members and any persons you mention in your entries. For your own account and billing details we are the controller (see Privacy).

We process this data only on your documented instructions, which are these terms and your use of the functions of the service, unless the law requires otherwise. Persons with access are bound to confidentiality. We take appropriate technical and organisational measures (Art. 32 GDPR), including encrypted transmission, personal access links, daily backups and encrypted off-site backup copies. You authorise the sub-processors listed in our Privacy notice under "Sub-processors and recipients". We inform you by e-mail before adding or replacing a sub-processor for this data; you may object, and if we cannot address the objection you may terminate with a pro-rata refund. We remain responsible for our sub-processors. We support you, as far as reasonable, in answering requests from data subjects, inform you without undue delay of any personal data breach affecting your data, and delete your work data within 30 days after the end of your plan without basic plan, or after the end of the basic plan, including in backup copies, unless the law requires us to keep it.

You are responsible for the lawfulness of what you enter. Please do not enter personal contact details of building owners, residents or other people.

9. Liability

The data is provided "as is". We are liable without limitation for intent and gross negligence and for personal injury. For slight negligence our liability is excluded to the extent permitted by law and in any case limited to the fees paid in the 12 months before the claim. Within these limits we are not liable for decisions you take on the basis of the data, including cases that turn out to be already awarded, estimates that differ from actual penalties or job sizes, or bids not won. Mandatory statutory liability remains unaffected.

10. Law and disputes

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Before either party starts court proceedings, it first sets out its claim in writing to the other party (including by e-mail or, for claims against us, through our contact form), and both parties try to settle the matter in writing within 30 days of that notice. Urgent interim relief remains possible. If no settlement is reached, the courts at the seat of the defendant have exclusive jurisdiction.

11. Final provisions

We may update these terms for future renewal periods; we e-mail the changes with the renewal notice, and you can switch off renewal if you do not agree. Notices may be given by e-mail. If any provision is invalid, the remaining provisions stay in force. The English version is the only binding version.
